This Privacy Policy describes how HerdAble Inc., an Indiana corporation (“HerdAble”, “we”, “us”, “our”) collects, uses, stores, and shares your personal information when you access and use the Application. By accessing and using the Application you agree to the practices described in this Privacy Policy. If you do not agree with our practices, your choice is to not use the Application. This Privacy Policy incorporated into our Terms of Service (together, the “Policy”), and capitalized terms used in this Privacy Policy, but not defined, have the meaning set forth in the Terms of Service.
1. Information We Collect and How We Collect Information
1.1 We may collect information that identifies, relates to, or could reasonably be linked to you or your household (“Personal Information”), including but not limited to your name, email address, or other contact information. We collect this Personal Information when you create an Account on the Application. When you download the Application from a Third-Party Platform, we may obtain some of your Personal Information from the Third-Party Platform to help us provide the Service to you. If we provide the option to sign into the Application through a single sign-on provider (each, an “SSO Provider”), we may obtain Personal Information such as your name and email address from the SSO Provider. You authorize us to obtain Personal Information from Third-Party Platforms and SSO Providers, and authorize Third-Party Platforms and SSO Providers to disclose Personal Information to us.
1.2 If you use the Application on a mobile device and turn on notifications in your device settings, we may collect a token associated with your device (a “Notification Token”) and store the Notification Token on our servers so we can deliver notifications to your device. If we store a Notification Token, it is rotated by your device’s operating system periodically and refreshed in our system automatically. The web version of the Application does not currently use push notifications.
1.3 We may also collect information regarding how the Application is accessed and used by Users, including but not limited to access times and features used within the Application (collectively, “Usage Data”). Usage Data is collected for every User of the Application. We may associate Usage Data with a unique identifier or with other information about you in our internal systems. Usage Data may be collected automatically as you use the Application.
1.4 If the Application crashes or encounters an error, we may receive a diagnostic report via our third-party crash reporting provider. These reports contain technical information (stack traces, application state, device model, OS version) and your unique User identifier, but not your Personal Information. You may disable crash reporting in the Application’s settings. Our crash-reporting provider retains crash reports for a limited period (currently up to 30 days), after which they are deleted.
1.5 If you send us a feedback report from within the Application, we receive the text you write, your User identifier, and up to three screenshots or images you choose to attach. Feedback attachments are stored with your Account’s other files and are deleted when your Account is deleted.
1.6 If you email us a document (for example, a registry certificate, a receipt, or a milk-test sheet) so that we can build support for reading that type of document, we keep it only for that purpose, in a restricted company folder, until support for that document type is released or 90 days after we receive it, whichever comes first, and we will delete it sooner on request. Please remove other people’s personal details from a document before sending it to us.
1.7 If you choose to turn on the weather feature, you may set an approximate location for your farm, either by using your device’s location once or by entering a ZIP code. We store only an approximate point (rounded to roughly two kilometers), not your street address, and we send that point to the National Weather Service, a United States government service, to retrieve the forecast and weather alerts for your farm. You can clear the farm location at any time in your farm settings, which turns the weather feature off and deletes the stored point.
2. How We Use Information
We may use your information in the manners set forth below. In this Privacy Policy, the term “information” includes any information we collect or obtain, including your Personal Information, Notification Tokens, and Usage Data, unless otherwise specified.
2.1. We will use your information to operate the Application, perform or fulfill services requested by you, to improve and tailor our Application and Service to better fit our Users, to inform you of changes to our Application or our policies, and to solicit additional information from you from time to time. We send service emails about your account and plan, including trial notices; the trial reminder emails include a link to turn trial emails off.
2.2. We may use your information to resolve disputes, troubleshoot problems, provide User and Account support, and enforce our agreements with you, including our policies, and to complete any payments you make through the Application.
2.3. We will not sell your Personal Information. We may use, reproduce, copy, and publish information that has been de-identified, anonymized, and aggregated such that it is no longer capable of identifying you (“De-Identified Data”). HerdAble is the owner of any De-Identified Data and may use it for any lawful purpose.
2.4. We may use information for any other specific purpose that we communicate to you upon collection of the same, and for any purpose that you approve or for which you direct us to use such information.
3. Who We Disclose Information To
We will not sell your Personal Information. We may disclose Personal Information, Notification Tokens, or Usage Data as set forth below, and you hereby consent to such disclosure:
3.1 We may disclose your Personal Information to third parties that make our Application available through their Third-Party Platform.
3.2 We rely on a number of third-party service providers to operate, develop, and continue to improve the Application. For example, we may disclose your information to IT service providers, such that they may support our IT systems, provide hosting, processing, and analyzing services with respect to information and data collected, and provide maintenance of such systems, or on the basis of other legitimate interests.
3.3 We may disclose Personal Information to Payment Processors to assist you in completing payments and to confirm whether payments have been completed, and/or we may disclose your information to credit card issuers and financial institutions in order to obtain payment from you, process payments, verify the absence of fraud, or assist in debt collection, in the course of the performance of a contract or on the basis of other legitimate interests.
3.4 We may disclose information to enforce other agreements with you, and if we believe disclosure is necessary or appropriate to investigate, prevent, or take action regarding illegal activities, suspected fraud, unauthorized use of third party rights, situations involving potential threats to the physical safety of any person, violations of this Policy, and as otherwise required or permitted by law or consistent with legal requirements.
3.5 We may disclose your information as appropriate to protect us, other Users, and third parties if we believe that you may harm, or have harmed, the property or rights of HerdAble, other Users, or any other third party, to report, disclose, limit, respond to, or prevent such conduct or activity.
3.6 We may disclose your information as part of a transfer or assignment if we are acquired by, sold to, or merged with another entity, or otherwise reorganized or liquidated.
3.7 We may share information for other specific purposes that we communicate to you upon collection of the same, and for any purpose that you approve or for which you explicitly direct us to use such information.
4. User Responsibility for Third-Party Personal Information
Certain features of the Application may allow you to upload documents or enter data that may contain information identifying, relating to, or reasonably linkable to a third party (“Third-Party Personal Information”). If you upload or enter Third-Party Personal Information, you represent and warrant that you have obtained any necessary permissions or authorizations to provide such information to us, and that doing so does not violate any third-party rights or agreements. We advise you to carefully consider uploading content containing Third-Party Personal Information to any public-facing portion of the Services (e.g., a message board or public profile).
5. Miscellaneous Application Functions
5.1 Information You Disclose to Other Users The Application may enable you to disclose your Personal Information to other Users of the Application. When your seller profile is published, when you post animal listings, when you send messages to other Users, when you leave a review, and when you post comments, questions, and other content on User community boards, you acknowledge that (i) you are choosing to disclose your Personal Information to other Users and (ii) unless otherwise noted in this Privacy Policy, we do not monitor or flag when you are disclosing your Personal Information to other Users. If you do not wish to disclose your Personal Information to other Users, your choice is to not use these Application features.
5.2 Browser Storage: If you access the Application through a web browser, we store your sign-in session (which includes your Account identifier and email address) and an offline copy of your farm records in your browser’s local storage. This allows you to remain signed in and use the Application without an internet connection. This information is stored only on your device and is not transmitted to third parties.
6. How Long we Keep Your Information
We keep your operational data for as long as your Account is active, if you have an Account.
When you delete your Account, your Account, all associated records, and all photos and documents are permanently deleted from our active systems immediately. Disaster-recovery backups expire on a rolling schedule, and backup copies containing your data will be purged within 365 days of your deletion request. If your farm has other members at the time you request deletion, you must first transfer ownership or remove those members before your Account can be deleted. If you are a member of another User’s farm (but not the owner), deleting your Account removes your access and membership, but records you created on that farm remain as part of that farm’s operational history with your identity removed.
De-Identified Data that has already been aggregated prior to your deletion request is not subject to deletion, as it is no longer capable of identifying you or being attributed to your Account.
7. Animal and Farm Operational Data
A core function of the Application is to help you manage your livestock operation. When you use the Application, you may enter information about your animals and farm, including: records about individual animals (such as name, sex, date of birth, registration number, parentage, breed, species); health events; breeding records; birth records; weight and body-condition observations; animal photos; scanned or imported documents (such as registration papers, vet records, and appraisal reports); and reminder and task schedules.
This animal and farm operational data is distinct from your Personal Information. We use this data to provide and improve the Application and Service. We will not sell your individual animal records. If we offer a program providing aggregated, de-identified insights pooled across farms (for example, regional or breed-level benchmarks), participation will be opt-in, and you will have the opportunity to consent before any of your farm’s data is included in such aggregated insights. Any aggregated data will not identify you, your farm, or your individual animals.
8. Your Rights Under US State Laws
In the United States, depending on your state of residence, and subject to certain exceptions, you may have some or all of the following rights with respect to the privacy of your Personal Information:
8.1 Right to Know: The right to request that we disclose to you the Personal Information we collect, use, or disclose, and to access the same.
8.2 Right to Request Correction: The right to request that we correct inaccurate Personal Information that we maintain about you.
8.3 Right to Request Deletion: The right to request that we delete Personal Information that we have collected from or about you. (Please note that you may not be able to maintain access to the Application without our retention of certain Personal Information.)
8.4 Right to Portability: The right to obtain a copy of your Personal Information that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller.
8.5 Right to Opt Out: The right to opt out of the processing of your Personal Information for purposes of targeted advertising and profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
To submit a request to exercise your rights set forth in this Section 8, and as applicable, to appeal a consumer rights action, you may contact us at privacy@herdable.app. We may require that you verify your identity to respond to your request. If you are entitled to a substantive response, we will deliver the requested information to you within 45 days (or will inform you that an extension of such timeframe is necessary). You may make a request up to twice during a 12-month period. We will not discriminate against you for exercising your rights pursuant to applicable state laws. In certain states you have the right to designate an authorized agent to submit requests on your behalf.
9. Children’s Privacy
The Application is not directed to individuals under the age of 18, and we do not knowingly collect Personal Information from children under 18. If you are a parent or guardian and believe your child (or a consumer of whom you are the guardian) has provided us with Personal Information without your consent, please contact us and we will take steps to delete such Personal Information from our systems.
10. Changes to This Policy
We may update this Privacy Policy from time to time in our sole discretion. All changes are effective immediately when we post them, or if required by law, when we provide notice to you of such changes. Such changes apply thereafter, and by continuing to use the Application after changes take effect you accept the updated Privacy Policy.
